These Terms and Conditions ("Terms") govern your use of azure-residences' website and luxury house rental services in Singapore. By accessing our website or using our services, you agree to be bound by these Terms.
Please read these Terms carefully before making any reservations or using our services. If you do not agree with any part of these Terms, you should not use our website or services.
1. Definitions
- "Service" refers to luxury house rental and associated concierge services provided by azure-residences
- "Property" means any residence available for rental through our platform
- "Guest" or "User" means any person accessing our website or booking our services
- "Booking" refers to a confirmed reservation for a Property
- "We," "Us," "Our" refers to azure-residences
- "Agreement" means these Terms and any rental agreement executed
2. Use of Services
2.1 Eligibility
- Users must be at least 18 years old to make bookings
- Users must have legal capacity to enter into binding contracts
- Corporate bookings must be made by authorized representatives
- Valid identification and payment methods are required
2.2 Account Responsibilities
- Provide accurate, current, and complete information
- Maintain confidentiality of account credentials
- Notify us immediately of unauthorized access
- Accept responsibility for all activities under your account
2.3 Booking Process
- All bookings are subject to availability and confirmation
- Minimum stay requirement of 7 days applies to all properties
- Extended stays may qualify for preferential rates
- Bookings become binding upon our written confirmation
3. Property Use and Guest Obligations
3.1 Permitted Use
Properties are provided exclusively for:
- Residential accommodation purposes only
- The number of guests specified in the booking
- Quiet enjoyment consistent with luxury residential standards
- Lawful activities in compliance with Singapore regulations
3.2 Prohibited Activities
Guests may not:
- Exceed maximum occupancy limits
- Host parties or events without prior written approval
- Engage in commercial activities or subletting
- Cause damage beyond normal wear and tear
- Violate noise restrictions or disturb neighbors
- Smoke in non-designated areas
- Bring pets without prior approval and additional fees
- Remove or relocate property furnishings or artwork
3.3 Security and Safety
- Comply with all security protocols and procedures
- Report any security concerns immediately
- Maintain confidentiality of access codes and keys
- Ensure property is secured when unoccupied
4. Payment Terms
4.1 Rates and Fees
- All rates are quoted in Singapore Dollars (SGD)
- Rates are subject to availability and seasonal variations
- Additional services incur separate charges
- Government taxes and service charges apply where applicable
4.2 Payment Schedule
- 50% deposit required upon booking confirmation
- Balance due 14 days before check-in
- Security deposit equivalent to 7 days rental required
- Accepted payment methods: bank transfer, credit cards
4.3 Security Deposit
- Held to cover potential damages or violations
- Refunded within 14 days after check-out
- Subject to deductions for damages or additional charges
- Itemized statement provided for any deductions
5. Cancellation and Refund Policy
5.1 Guest Cancellations
- 30+ days before arrival: Full refund minus processing fee
- 14-29 days before arrival: 50% refund
- 7-13 days before arrival: 25% refund
- Less than 7 days: No refund
5.2 Modifications
- Date changes subject to availability and rate adjustments
- One modification permitted without fee if made 30+ days prior
- Subsequent modifications incur administrative fees
5.3 Force Majeure
Neither party shall be liable for cancellations due to circumstances beyond reasonable control, including natural disasters, pandemics, government actions, or travel restrictions. Alternative dates or credit vouchers may be offered.
6. Liability and Disclaimers
6.1 Limitation of Liability
- Services provided "as is" without warranties beyond those required by law
- Not liable for indirect, consequential, or punitive damages
- Maximum liability limited to total fees paid for the specific booking
- Not responsible for third-party service failures
6.2 Guest Liability
- Guests liable for all damages caused by negligence or misuse
- Responsible for actions of all occupants and visitors
- Must maintain adequate travel and personal property insurance
- Indemnify azure-residences against third-party claims
6.3 Property Conditions
While we maintain properties to the highest standards, we do not warrant uninterrupted utilities or services. Reasonable efforts will be made to address any issues promptly.
7. Intellectual Property Rights
- All website content, property descriptions, and images remain our property
- Limited license granted for personal, non-commercial use
- No reproduction, distribution, or modification without written permission
- Property photography for personal use only, commercial use prohibited
- azure-residences trademarks and logos are protected
8. Privacy and Confidentiality
- Personal data handled according to our Privacy Policy
- Guest information kept strictly confidential
- Security footage used only for safety and security purposes
- Staff bound by non-disclosure agreements
- No sharing of guest information without consent or legal requirement
9. Dispute Resolution
9.1 Resolution Process
- Initial attempt at informal resolution through direct communication
- Formal mediation if informal resolution unsuccessful
- Binding arbitration under Singapore International Arbitration Centre rules
- Each party bears own legal costs unless otherwise determined
9.2 Governing Law
These Terms are governed by the laws of Singapore. Any disputes shall be subject to the exclusive jurisdiction of Singapore courts, except where arbitration applies.
10. General Provisions
10.1 Entire Agreement
These Terms, together with any rental agreement, constitute the entire agreement between parties and supersede all prior understandings.
10.2 Severability
If any provision is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.
10.3 No Waiver
Failure to enforce any provision does not constitute a waiver of our rights to enforce such provision in the future.
10.4 Assignment
Guests may not assign or transfer their rights under these Terms without our prior written consent.
10.5 Modifications
We reserve the right to modify these Terms at any time. Material changes will be notified via website or email. Continued use after modifications constitutes acceptance.
